Austin Summers, 31, is now facing one charge of vehicular manslaughter and two counts of injury to a child in connection with the November 25 crash on Interstate 84 that killed his eldest son, Graham, and left his two other boys injured.
The father-of-three was driving his GMC pickup truck on the westbound interstate at 73 to 75 mph in a posted 65mph zone when he collided into the rear of a Ford F-450 that was traveling at just 7mph with its hazard lights due to a mechanical issue, authorities said in a probable cause affidavit obtained by the Idaho Statesman.

Graham was then found dead in the passenger seat, where police said he was not wearing his seatbelt.
The Canyon County coroner’s report later determined that the young boy died of multiple blunt force injuries.
Meanwhile, Summers was found injured and trapped in the driver’s seat of the vehicle, while his two other children, ages three and five, were found injured in the backseat.
All three were then transported to a local hospital and survived their injuries.
But when Idaho State Police later investigated the crash, they learned that Summers had been using his phone extensively in the moments leading up to and during the crash.
They also allegedly found that Summers’ blood samples tested positive for cocaine and opiates.
