Biological father a.b.u.s.e.s 4-year-old son to d3:ath in Portland: Heartbreaking revelation about the mother’s prior actions that leaves everyone outraged
A 23-year-old Portland man was sentenced to 10 years in prison Monday in the death of his 4-year-old son in 2023.
Marquavious Ware accepted a deal from prosecutors last month, pleading guilty to second-degree manslaughter and custodial interference in the death of Jahorden Clay. Ware will receive credit for more than three years of time served.
Court records state that Jahorden died from blunt force trauma and a collapsed heart, as well as suffering from severe malnutrition and dehydration, while in Ware’s care. Prosecutors said Ware had failed to return the boy to his mother, who had legal custody, after a scheduled two-day visit.
A woman identified in court only as Jahorden’s maternal aunt addressed Judge Melvin Oden-Orr before the sentence was handed down. Fighting back tears as she spoke, the woman said it had been her sister Jonicia Clay’s “greatest purpose in life to be Jahorden’s mother.”
Ware’s court-appointed attorney, Brook Reinhard, told the court that his client never intended for his son to die and blamed some of the child’s injuries on another person Ware knew.
Reinhard said Jahorden’s death “weighed heavily” on Ware and that Ware accepted responsibility for allowing the circumstances that led to the boy’s death, prompting him to accept the plea agreement.
Addressing the court himself before sentencing, Ware turned toward several tearful members of Jahorden‘s family seated in the gallery. He said he wished he could bring Jahorden back and that no one else was responsible for the boy’s death.

Ware then turned back toward the bench and remained silent for the remainder of the hearing.
Reinhard and co-counsel Lisa Ludwig asked Oden-Orr to recommend that the Oregon Department of Corrections house Ware at Two Rivers Correctional Institution in Umatilla, where his uncle is incarcerated. They said that being near his uncle would provide Ware with support and help him make “positive change” while serving his sentence.
Oden-Orr accepted the recommendation and sentenced Ware to 75 months in prison for second-degree manslaughter and 45 months for custodial interference. As part of the plea, prosecutors dismissed charges of murder and assault.
Portland police and paramedics responded to an apartment in Northeast Portland’s Woodlawn neighborhood on May 3, 2023, according to court records. They took Jahorden to a hospital after finding blood in his lungs. The boy later died at the hospital.
Suspecting abuse, investigators interviewed one of Ware’s relatives, Martayvious Ware, who told police he had heard yelling and later found Marquavious Ware in a bathtub with Jahorden, washing blood from the child’s mouth, court records show. Officers searching the apartment found blood on a bed, floor and pillow upstairs, as well as vomit in the bathroom.
Jahorden was pronounced dead at Legacy Emanuel Health Center. Doctors found bruises on the child’s face, neck, chest, legs and arms. They estimated the injuries ranged from a few hours old to less than 30 days old. They also found burns on Jahorden’s back consistent with cigarette burns and numerous scars across his body.
During an autopsy, medical examiners found lacerations to Jahorden’s lungs, liver and pancreas, in addition to recently broken ribs and internal bleeding, court records state.
On Monday, Multnomah County Deputy District Attorney Rachna Hajari told Judge Oden-Orr that the boy had been “tragically murdered” and asked the judge to impose the recommended 120-month sentence.
Oden-Orr also granted Hajari’s request that Ware be ordered to pay nearly $5,000 in restitution costs to the state for victim-support services provided to Jahorden’s family.
A $17 million lawsuit filed by Jahorden‘s estate against the Oregon Department of Human Services and the City of Portland remains ongoing. The lawsuit alleges the state agency failed to protect the boy from his father despite repeated reports of abuse.
In an internal review conducted after Jahorden’s death, the agency found it had failed to adequately investigate prior reports of abuse.
Less than a month before the boy’s death, on April 19, 2023, his mother submitted FaceTime screenshots to the agency showing a bruise on Jahorden’s forehead, according to DHS records. She also reported that Jahorden had been staying with Ware for several weeks, having failed to return the child following a scheduled two-day visit.
Despite the abuse allegations, DHS closed the case, according to a report completed following the child’s death. Jahorden died two weeks later.
Reinhard told the court the plea agreement and sentence provided closure for Ware and Ware’s family and said his client hopes to grow from the experience while incarcerated.
