The Kyle and Jackie O Show may yet return to air- but new conditions could dramatically change the way the controversial breakfast program operates.

The Australian Communications and Media Authority (ACMA) has imposed special licence conditions on Australian Radio Network (ARN) following an investigation into The Kyle & Jackie O Show.

A number of controls will be placed on ARN’s KIIS FM, which broadcasts the breakfast show hosted by Kyle Sandilands and Jackie ‘O’ Henderson, to ensure stricter operating standards in the wake of the radio shock jocks’ on-air fallout.

While the future of The Kyle and Jackie O Show has not yet been revealed, the new regulations paint a picture of what the radio program could look like if it returns to air.

According to a market announcement released by ARN, the new ACMA conditions will apply for five years and will affect any program hosted by Henderson and/or Sandilands, not just the current show format.

Some of the new rules include complying with broadcast decency rules to ensure the duo’s content meets public standards, as well as limiting sexual language and references to avoid offending listeners.

These include “spoken words and/or sound effects that would be understood by the ordinary reasonable listener as having a sexual meaning”, according to the announcement.

Furthermore, an independent compliance expert will be hired to monitor the show’s internal systems, and an audit of its “governance framework” must be completed within six months, with any required changes to be implemented within three months.

The market announcement added that the show can continue to broadcast, but it will operate under much stricter oversight by ACMA.

However, the new rules could drastically impact the format of the show, which has become well-known for its provocative, “shock jock” style and vulgar content.

It comes just one day before ARN reveals whether it will proceed to fire Sandilands, after an on-air bust-up saw him suspended over what the network is calling a breach of his contract.

Sandilands was given until Tuesday to “remedy” the alleged “serious misconduct”, despite Henderson’s contract being terminated after she allegedly claimed she “could not continue” to work with her longtime co-host.

Henderson has maintained that she “did not quit”, with insiders claiming she has threatened legal action against the Australian Radio Network for wrongful termination.

Despite the scandal, close sources have further alleged that both Henderson and Sandilands are in contact and “communicating like the great mates they are”.

On February 20, Henderson was left in tears during a broadcast after Sandilands accused her of letting her interest in astrology affect her work ethic.

“It’s affecting other things, like your fixation on this has made you almost unworkable. You’re off with the fairies with this s***. It’s mental,” Sandilands raged.

Sandilands claimed that “everyone in the building” had complained about her for “not doing the rest of the job”.

“I would never say things like that about you,” Henderson hit back at Sandilands.

“It’s a total attack, it really is … to say, ‘You don’t know what the F is going on, you’re not doing your job’, that’s an attack and I wouldn’t do that.”
