An FBI agent testified that during the investigation into Anna Kepner’s death, they learned about a past incident involving her stepbrother Timothy Hudson.

Anna Kepner allegedly had concerns about her stepbrother Timothy Hudson long before the two set off on the ill-fated cruise that ended in her death and his indictment on charges of murder and aggravated sexual abuse.

At a February court hearing to determine if Timothy, 16, would be held in custody or released prior to his criminal trial, FBI Agent Andrew del Valle testified about a concerning incident between Anna and her stepbrother that he learned about while investigating her death.

Del Valle said that multiple interviews were conducted with friends of Anna after her death as well as with her ex-boyfriend, who allegedly told investigators that he witnessed a “strange moment” between Timothy and Anna, according to a transcript from that hearing obtained by PEOPLE.

Anna and her ex-boyfriend were in constant contact during the time they dated, del Valle testified, and would often fall asleep while on FaceTime.

“During one of those FaceTime conversations, he recalls that [Anna] had fallen asleep and he was doing some work in his garage or something, but he noticed or he heard a noise coming from [Anna’s] phone,” del Valle testified. “He looked and he states that he had seen [Timothy] trying to get into bed with [Anna].”

The ex-boyfriend “was kind of surprised and shocked by it,” del Valle said in court, and he “yelled at [Timothy]” from the phone, at which point Timothy “apparently ran out of the room.”

He said that Anna managed to sleep through the incident, but her ex-boyfriend informed her about what happened the next day.

Even after learning what had happened while she was asleep, Anna told her ex-boyfriend that she “had been hesitant about saying anything to the father,” according to del Valle.

According to the ex-boyfriend, Anna allegedly said she “felt that [Timothy] was a little weird and that he had quite a few knives, so she was a little bit afraid of him,” per del Valle’s testimony.

Timothy’s mother and Anna’s stepmother, Shauntel Kepner, however, previously claimed that the two were “best friends.” This came at an emergency custody hearing after her ex-husband, Thomas Hudson, petitioned the court to remove his youngest daughter from her mother’s residence and grant him custody.

He filed that petition after learning that his 16-year-old son was under investigation by the FBI in the death of Anna, who “was found asphyxiated under the bed in the room which she shared with [his teenage son],” according to a court filing obtained by PEOPLE.

Shauntel testified during a December appearance in family court that Timothy and Anna came to share a room with her stepbrother and 13-year-old half-brother at their own behest.

“Yeah, the three of them are, like, the three amigos,” Shauntel said at the time. “They are best friends.”

In February, Timothy was arraigned in a Florida federal courtroom on charges of sexual abuse and murder before being released back into the custody of a maternal relative.

He remains in the custody of that relative, who he was sent to live with back in November of last year, after the judge ruled on May 27 that he would not amend the conditions of Timothy’s pretrial release despite the fact he is now being tried as an adult.

Shauntel has not spoken publicly about Timothy beyond that December court hearing, but court documents filed in Brevard County as part of an ongoing custody dispute between Shauntel and her ex-husband reveal that she cut all ties with Timothy as soon as their cruise returned to port on Nov. 8 and has not spoken to her son since that time.

Timothy is accused of sexually assaulting and then killing Anna while the two were on their first blended family cruise following the marriage of his mother Shauntel to Anna’s father Christopher Kepner.

Anna was last seen returning to the stateroom she was sharing with Timothy and her half-brother just after 7:30 p.m. on the night of Nov. 6, 2025, according to court filings.

She was found dead under her bed just before noon the next day, and the Miami-Dade Medical Examiner’s Office later determined her cause of death to be mechanical asphyxiation and her manner of death to be homicide.

Timothy’s mother has stated that she believes her son should be in custody.
