The investigation then took another devastating turn when investigators recovered some of Javeayah’s remains from a reservoir. Authorities later said DNA analysis confirmed the remains belonged to the 4-year-old.

Parents Face Serious Criminal Charges
Both of Javeayah’s parents, Michilae Herring and Johmarea Harris, have been arrested in connection with the case.
Authorities have charged them with homicide by child abuse and desecration of human remains.
According to investigators, the allegations surrounding the handling of the child’s remains have become one of the most disturbing aspects of the ongoing investigation.
The arrests, however, do not mark the end of the investigation.

University of South Carolina criminology professor Scott Mourtgos explained that an arrest represents only one stage of a criminal investigation.
He said investigators are continuing to build a comprehensive timeline to determine when Javeayah was last known to be safe, when she may have been injured, and who had contact with her during that critical period.
According to Mourtgos, investigators will likely continue reviewing surveillance footage, digital records, forensic evidence, and witness statements as they strengthen their case.
He also emphasized an important legal distinction.
Probable cause, which allows police to make an arrest, is not the same as proving guilt beyond a reasonable doubt in court.
For that reason, investigators often continue collecting evidence long after arrests have been made.
Mourtgos also noted that recovering only partial human remains can present significant challenges during a murder prosecution.
Without a complete body, prosecutors may face additional hurdles when presenting forensic evidence to a jury, even though such cases can still result in convictions.
Could Prosecutors Seek The Death Penalty?
Another major question surrounding the case is whether prosecutors will pursue the death penalty.
Criminal defense attorney Dayne Phillips explained that South Carolina law includes statutory aggravating circumstances that can make certain homicide cases eligible for capital punishment.
He noted that the alleged death of a child under the age of eleven, combined with allegations involving the dismemberment of human remains, are factors that could legally permit prosecutors to file notice seeking the death penalty.
However, Phillips stressed that eligibility does not guarantee prosecutors will pursue capital punishment.
He explained that the decision ultimately rests with the solicitor handling the case.
Capital prosecutions require years of preparation, extensive financial resources, and careful consideration because juries may still choose to impose life imprisonment rather than a death sentence.
At this stage, Phillips said, it is far too early to predict what prosecutors will ultimately decide.

While investigators continue gathering evidence and legal questions remain unanswered, the community has shifted its focus toward remembering Javeayah.
